The transfer policy of Junior Engineer & Ministerial / Operating will be as in year 2004-2005

    The guiding Principle of transfer   policy 2005-06 

The guiding principle and transfer procedure of the transfer policy for the year 2005-06 for all officers of UP PCL working in Distribution/Transmission and Accounts organizations

 1.      OBJECTIVE

                    This transfer policy is being formulated keeping in view the basic objective of all round development and increasing the efficiency of the officers working in the UPPCL. This policy is also based on the principle that the officers posted in the field will remain fully aware towards better consumers service and increasing revenue realization.

 2.      GENERAL PRINCIPLES OF TRANSFER POLICY FOR THE OFFICERS OF THE CORPORATION.

                    Transfer orders within the Corporation shall, generally be issued in accordance with these prescribed guiding principles.

 2.01  NORMAL TENURE OF POSTING SHALL BE AS BELOW:

                    Assistant Engineer to Chief General Manager and equivalent officers.

           (a)     On one Post                  -        3 years

          (b)     In  a District                  -        6 years

          (c)     In a Commissionary      -        10 years

                    The tenure shall be reckoned from the Ist of April of the year. Assistant Engineer and equivalent officers shall be transferred by the Managing Director concerned. But the transfers of all officers right from Executive Engineer to Chief General Manager and equivalent post shall be made by the Power Corporation. When officers are absorbed in any DISCOM, the Managing Director's shall transfer them in accordance with the above policy.

                    In view of the directives of Hon'ble Supreme Court to make the transfers with the approval of the "Independent Committee", it is not possible  to complete the transfers within the prescribed date, the last date for transfer is hereby fixed 30.06.05.

           2.01.1         Apart from the above time limit, the transfer can also be made as per requirement, on administrative grounds such as in the interest of Corporation, inefficiency in the work etc. and others such as promotion, dismissal, retirement or personal grounds.

  2.01.2 The number of transferred officers shall be generally restricted to 10% of the  total sanctioned posts. If the number of transferred officers exceeds the above limit, the approval of the Board shall be obtained in case of officers right from Executive Engineer to Chief General Manager and equivalent posts and the approval of the Chairman & Managing Director shall be obtained in the case of officers of the post of Assistant Engineer and equivalent. The transfers made from Power Corporation to U.P. Rajya Vidyut Utpadan Nigam Ltd./U.P. Jal Vidyut Nigam Ltd.or vice versa and the transfers to be made on promotion, shall not be included in the above limit. In addition to this, the transfers to be made  in respect of final absorption of officers in various DISCOMS, shall remain free from the above limit.

2.01.3The officers concerned shall be free to give options for the transfer and  as far as possible efforts for posting shall be made accordingly.

2.02   Under normal circumstances, officer shall not be posted on the same place/office before 3 years where he has already worked. In special circumstances, if it is expedient to do so, the officer empowered to transfer, could do so only after obtaining prior approval of the officer one step higher to him.

2.03   Those officers who have completed 6 years of their entire service in a district and 10 years of their entire service in a commissionary, shall be transferred from the district/commissionary respectively.

2.04   The officers from the post of Executive Engineer to Chief General Manager and equivalent, shall not be posted in home commissionary and Assistant Engineer and equivalent officers shall not be posted in home district.

2.05   The provisions of normal tenure of posting as contained in para 2.01 shall not apply on Corporation's headquarters, officers posted on non-sensitive posts in the units attached to Corporation's Headquarters and officers posted in specialised/indispensable technical units. But this relaxation should not be granted for the officers posted on the post of direct public dealing work.

2.06   Officers of doubtful integrity shall never be posted on sensitive posts.

2.07   If the punishment of two censure entries, in last 5 years (It means after finalisation of the representation) or one major punishment has been inflicted upon the officer, such officer shall not be posted on sensitive post. The aforesaid censure entries shall be in two different cases. The calculation of aforesaid 5 years shall be made from preceeding 5 years of the transfer season.

2.08  If husband and wife both are in corporation's service, efforts shall be made to post them in the same district or place as far as possible.

2.09  On personal grounds of any officer such as medical or education of the children etc. the officer could be transferred/accommodated in the event of vacancy or mutual consent of the other officer.

2.10  Physically handicapped officers or such officers whose dependent members of the family are affected with disability, shall remain free from general transfer. The transfer of such a disabled officer shall only be made on serious complaint or unavoidable reasons. On the request of physically handicapped officer, he may be considered to be posted in his home district on availability of the post.

2.11  On the basis of the medical certificate provided by the authorised medical officer of the power corporation/Govt. Doctor, efforts shall be made to post the parents of mentally retrarded children in accordance with their option, as far as possible, to such places where adequate medical facilities are available.

2.12  T.A. shall not be admissible to such officers whose transfer have been made on their own request.

3.0   For the posting of Executive Engineers and equivalent officers of each category, their suitability, general goodwill and the points of efficiency found in review of the work done by them, shall be considered.

4.0    The transfer of the President/Secretary of the recognised employee's Unions of the Power Corporation in which President/Secretary of the Distt. Units are also included, shall not be made till two years from the date of taking over charge in the Union . However, if it is expedient to transfer them, prior approval of one step higher officer shall be obtained by the authority competent to transfer them.

5.0 Transfer Procedure

 5.01  Managing Directors shall make available category-wise seperate list of such AEs and equivalent officers whose tgransfers are proposed out of their Discom due to administrative reasons, reasons to be recorded, to the Director(P&A).

 5.02  Managing Director shall make available category-wise separate list of officers of the rank of Executive Engineer to Chief General Manager and equivalent officers whose transfers are proposed due to administrative or extra-ordinary reasons, reasons to be recorded, to the Chairman-cum-Managing Director.

 5.03  The allotment of officers upto the rank of Asstt. Engineers and equivalent shall be made by 30th June in due time by the Corporation

 5.04  It shall be the responsibility of the controlling officer that the transferred officer should be relieved within 7 days from the date of receipt of transfer order without waiting for the substitute. It shall be the responsibility of the transferred officer that after having been relieved, he should join at the new place of posting within the prescribed time limit. After the stipulated period, the transferred officer shall have no right, under any circumstances, to draw his salary from old place of posting.

 5.05  If any transferred Officer is not relieved without obtaining prior approval of the Corporation, the controlling officer and the General Manager/Chief General Manager shall be held responsible.

5.06  It shall be the responsibility of the officer proposing transfer that he should not conceal any fact about the employee to be transferred. If any thing contrary to it comes to notice in future, the Controlling Officer shall be held responsible for the same.

 5.07  Stricts disciplinary action shall be taken against the controlling officer/GM/CGM concerned, found guilty of assisting in defiance of transfer orders, treating it as violation of Govt. servant conduct Rule-27. Representation for cancellation of transfer orders of the transferred officers should not be forwarded.

 5.08  The act of defying transfer orders or trying to exert pressure for cancellation of transfer orders by the officers, shall be treated as violation of Govt. servant conduct rule-27 and strict disciplinary action shall be taken against them. Apart from the above the competent authority may contemplate suspension under Rule-4 of Govt. servant (Discipline & Appeal) Rules, 1999, and expedient action be taken.

 5.09  The controlling officers of the officers posted in Bundelkhand Area shall not relieve the transferred officers until their substitute joins. But the above relaxation shall not be applicable on the transfers made on administrative grounds.

 5.10  In case of officer not joining on the new place of posting on promotion, a letter in black and white shall be obtained from him to the effect of fore-going his promotion and accordingly expedient action shall be taken mentioning the same in his service records.

 5.11  It shall be the responsibility of the transferred officer that he should prepare a charge-note regarding important matters/programmes/ projects before being relieved, so that the new officer may feel easy to dispose off the work.

 6.0  First appointment/posting of the officers of Transmission organisation:  

 6.01  Normally degree-holder Asstt.Engrs. in their first three years of service be posted at 400 KV sub-stations, shift duty in the system, Test&Commissioning Divisions, Microwave & Telecommunication Divisions and in MBMS.

 6.02  After completing three years of service in the units as mentioned in para 6.01 the Asstt.Engrs. may be posted on the sensitive post of SDO in the sub-division.

 6.03  Newly promoted execuvie engineers shall be firstly posted for shift wrok in Central/Area load despatch stations, Microwave & Telecommunication Division or in MBMS.

6.04  After completing two years of serive in the units as mentioned in para 6.03, Executive Engineers may be posted on sensetive post in the division.

 6.05  Some officers are not to be posted on sensitive post. It is therefore, sensitive posts under different organisations are defined as under: 

 7.0   Distribution Organisation

          (1) All Electricity Distribution Circles including Urban Distribution Circles and various Divisions and Sub-divisions attached to them.

          (2)     All Electricity Test Divisions and Asstt.Engineer(Meters) under Electricity Distribution Circle /Urban Distribution Circle .

          (3)  All Stores Purchase Circles and posts of Execuvie     Engineers/Asstt. Engineers attached  to them.

          (4)     All Stores Circle and various Divisions and Sub-Divisons          attached to it.

          (5)     All Electricity Works Circle /Workshop Circles and Divisions     attached to it.

          (6)    All the posts of Equator Unit.

8.0   Transmission Organisation

          (1)    All Electricity Transmission Circle and various Divisions and       Sub-Divisions attached to them.

          (2)    All Transmission Design Circle and all concerned Executive         Engineers.

          (3)    Dy.G.M. (System Operation) and Executive Engineer (ALDS)

 9.0   Civil Organisation

          (1)    All Electricity Civil Distribution Circle and all other Divisions       and Sub-Divisions attached to it.

          (2)     All Electricity Civil Transmission Circle and all other         Divisions and Sub-Divisions attached to it.

 10.0  Accounts Organisastion

          (1)  Posts of Dy. Chief Accounts Officer/Senior Accounts         Officer/Accounts Officer/Asstt.Accounts Officer in        Distribution/ Transmission Organisation

          (2)     Posts of Dy.Director/Accounts Officer/Asstt.Accounts    Officer in Internal Audit.

          (3)     All posts of Dy.Chief Accounts Officer/Sr.Accounts Officer  who have the power of Drawing and Disbursing and operation of Bank Account.

 The Guiding Principles and Transfer Procedure of the Transfer Policy for the year 2005-06 for the officers and officials of Corporation's Headquarters' Cadre.

1.  Objective

                   This transfer policy is being formulated keeping in view the objective of all round development, increasing efficiency/working capacity of the officers/officials working in the UPPCL Headquarter and to acquaint them with the various work being performed by the Corporation.

                   In supercession of all previous orders regarding classification of all sections/camps/cells of the Corporation's Heqrs. based on the importance of work, their reclassification is being done on the basis of nature of work as here under:

                    In supercession of all previous orders regarding transfer of officers/officials of UPPCL's Heqrs. Cadre, the following policy for the purpose of their transfer is formulated. The tenure shall be reckoned from the Ist April of the Year. In view of the directives of Hon'ble Supreme Court to make the transfer with approval of the "Independent Committee", it is not possible to complete the transfers within the prescribed date, the last date for the transfer is here by fixed 30.06.2005.

1.      Office Asstt.Gr.-III/ARO/RO and equivalent

          Those Office Asstt.Gr.-III/ARO/RO and equivalent who have completed six years service in the same section/cell/camp and ten years service in the same Group, shall be transferred from the section/cell/camp or Group, as the case may be.

2.      Section Officer and equivalent

          Those section officers and equivalent of the UPPCL's Hqrs. who have completed 5 years of service in a section/cell/camp and 7 years service in a Group shall be transferred.

3.      Under Secretary/Dy.Secy. & equivalent

          The above category of the officers of the UPPCL's Hqrs. shall be transferred after completing 5 years of service in the same group.

4.      Dy.GM/GM (Hq.cadre) & equivalent

          Officers of the above category of the UPPCL's Hqrs. can be posted in the same Group for a maximum period of 3 years.

5.      Any officer/official can be transferred from the group even before the prescribed time limit on the various administrative and indispensable reasons.

6.      Those officers/officials who are due to retire in one or less than one year, shall not be transferred as far as possible.

 7.      Any officer/official of the Hqrs.'s cadre transferred from any of the above mentioned five groups, shall not generally be posted (even on promotion) in the same group. If the officer/official has completed the prescribed time limit in that group.

8.      The specific date for relieving/of being relieved the person concerned should be mentioned clearly in the transfer orders and this should also be made clear in the transfer orders that the controlling officer of such transferred officer/official must relieve them by the prescribed date and thereafter their pay shall be drawn/disbursed from the new section where they have been transferred.

9.      The existing powers of Director(PM&A) to transfer any officer/official on administrative grounds shall remain intact and the powers of modification/cancellation of transfer orders, under unavoidable circumstances, shall also be vested in the Director (PM&A).

10.    Having ensured the immediate compliance of the transfer orders issued by the Sachivalaya Prashasan(11) Section of the Corporation's Hqrs., the transferred officer/official shall report at the new place of posting. The act of making representation for cancellation of the transfer orders or trying to exert pressure at any level for desired place of posting, shall be treated as violation of Rule-27 of the Govt. Servant Conduct Rules-1956 and the competent authority may contemplate disciplinary proceedings against such officers/officials also, under relevant Rules.
